This is an English translation of the German “Allgemeine Geschäftsbedingungen (AGB)”, provided for convenience. In case of doubt, the German version shall prevail (see section 13): AGB (in German).
These General Terms and Conditions (“Terms”) apply to all services offered by Katja Kaiser at katjakaiser-coaching.de.
The provider of the services is:
Katja Kaiser
Beethovenstraße 19
71701 Schwieberdingen, Germany
Email: hallo@katjakaiser-coaching.de
Website: katjakaiser-coaching.de
These Terms apply to all services, in particular:
Clients are predominantly companies and organisations; executive coaching can also be booked privately. Deviating terms of the client are not recognised unless the provider expressly agrees to their validity in writing. The services are aimed exclusively at persons aged 18 and over.
Katja Kaiser offers leadership development, executive coaching and training for companies and organisations. The services include:
The current services, formats and content are published at katjakaiser-coaching.de. The information at the time of booking or the individual written offer is binding.
The free introductory call (approx. 30 minutes) serves to get to know each other. It does not establish a service contract and involves no obligation.
A contract is concluded by:
For assignments from companies and organisations, the individual written offer is decisive; in the event of a conflict, it takes precedence over these Terms. By concluding the contract, the client confirms that they have read, understood and accepted these Terms.
Prices quoted to consumers are final prices including statutory German VAT, currently 19%. Prices quoted to businesses are exclusive of statutory VAT. All prices are in euros (EUR). The applicable prices are shown on the website or in the individual offer.
For business clients outside Germany, VAT is shown in the individual offer.
Talks, training days, transfer programmes as well as programme design and consulting are invoiced after the service has been provided, payable within 14 days of the invoice date. For formats lasting several days or with several parts, a partial invoice after conclusion of the contract may be agreed.
The three-month executive coaching is paid as a single payment or in three monthly instalments. Agreed instalments are due regardless of whether individual sessions are used. If payment is more than 14 days overdue, the provider reserves the right to suspend further sessions until the matter is resolved.
For in-person formats outside the Stuttgart/Ludwigsburg region, travel and, where applicable, accommodation costs are charged at cost, unless otherwise agreed in the offer.
Appointments can be rescheduled free of charge up to 48 hours before the appointment. In the event of cancellation or non-attendance less than 48 hours before the appointment, the session is deemed to have taken place and will be invoiced or deducted from the package. Exceptions in the event of proven unforeseeable events (e.g. acute illness with a medical certificate) by personal arrangement.
For corporate events with a fixed date, the following graduated terms apply:
Travel and preparation costs already incurred and evidenced must be reimbursed in any case. A one-off move to an alternative date confirmed by both parties within six months is possible free of charge up to 14 days before the date.
Cancellation is possible up to 14 days after conclusion of the contract, provided no session has yet taken place. After the start of the first session or after this period has expired, cancellation is no longer possible; instalments already agreed remain due. Exception: in the event of a proven long-term illness that makes continuation impossible, an individual solution will be sought.
If Katja Kaiser cancels (e.g. due to illness or unforeseen events), the full amount will be refunded or the appointment rescheduled free of charge, at the client’s choice. Any further liability is excluded.
Consumers have a 14-day right of withdrawal for distance contracts pursuant to Section 312g of the German Civil Code (BGB) in conjunction with Article 246a of the Introductory Act to the German Civil Code (EGBGB). This applies in particular to privately booked executive coaching.
If, at the express request of the consumer, a service begins before the withdrawal period has expired, the right of withdrawal expires pursuant to Section 356(4) BGB once the service has been provided in full. Separate notice of this will be given before the contract is concluded.
No right of withdrawal for business assignments: For contracts with companies, organisations and other non-consumers, there is no statutory right of withdrawal. For these, only the cancellation terms in Section 5 apply.
Katja Kaiser undertakes to maintain strict confidentiality regarding all personal and substantive information entrusted to her in the course of the collaboration. This also applies after the collaboration has ended.
The duty of confidentiality arises from the contractual duty of good faith under Section 242 BGB. In Germany, coaches are not subject to a statutory duty of confidentiality like doctors or psychotherapists, but are bound by this contractual agreement.
Exceptions apply if:
The use of anonymised case examples in supervision, further training or public contributions is permitted, provided that no conclusions whatsoever can be drawn about anyone’s identity.
For coaching and programmes commissioned by a company, the following applies: content from individual sessions is not reported to the client. Feedback is given exclusively in anonymised and aggregated form (e.g. the impact report for “Leading Steady”), with no possibility of identifying individual participants. This is made transparent to participants at the outset.
In training days and group formats, all participants are bound by mutual confidentiality. What is said in the room stays in the room. Katja Kaiser points this out at the start of every group event.
Methods, materials, concepts and input from the collaboration are the intellectual property of Katja Kaiser and may not be published, reproduced or used commercially without permission.
Participants may not record sessions or events – by video, audio or in any other form – without express written permission.
Coaching, training and breathing exercises offered by Katja Kaiser are not psychotherapy, not medical treatment and not a substitute for medical or psychiatric care. The services are not subject to the German Non-Medical Practitioners Act (Heilpraktikergesetz, HPG).
Coaching supports healthy adults in their professional and personal development, reflection and change. It does not deal with the treatment of mental illness, trauma or medical conditions.
Should it become apparent in the course of the work that the need goes beyond the coaching format, Katja Kaiser will address this openly and recommend referral to suitable professionals. In such a case, she is entitled to end the collaboration.
Participants are themselves responsible for seeking medical or therapeutic advice before taking part if they have an existing or suspected illness.
Participation is voluntary and at your own responsibility. Participants confirm that their state of health allows them to take part and that they will disclose relevant pre-existing conditions or limitations in advance.
Exercises from functional breathing (the Buteyko Method) are used in coaching sessions, training and the free breathing course. The method is gentle and suitable for most people. People with the following conditions should seek medical advice before taking part:
If you are unsure, please ask in advance: hallo@katjakaiser-coaching.de
Katja Kaiser provides all services with the greatest possible care. No guarantee can be given for specific results or successes; the process depends significantly on the participants’ own involvement.
Liability is governed as follows:
Liability is excluded in particular for:
All materials, methods, exercises, handouts, presentations and other content provided are protected by copyright and remain the property of Katja Kaiser.
Participants receive a personal, non-transferable right to use them for their own purposes. Commissioning companies receive the right to reproduce materials provided internally for the participants of the respective measure. Any further reproduction, disclosure, publication or commercial use – including of extracts – is not permitted without express written permission.
Testimonials and references are only published with express permission.
Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). The privacy policy is available at katjakaiser-coaching.de/en/privacy-policy.
In the course of providing the services, name, email address and, where applicable, other relevant information are collected. These are used exclusively to carry out and organise the services. Data is only passed on to third parties to the extent necessary to provide the services.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of performance and – to the extent permitted by law – the place of jurisdiction is Schwieberdingen.
If you are a consumer with your habitual residence in another country, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of that country.
Should individual provisions of these Terms be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
Changes to these Terms are published at katjakaiser-coaching.de and apply to new bookings from the time of publication. Existing contracts remain unaffected.
Side agreements, additions or amendments must be made in writing (email is sufficient).
Language: These Terms are available in German and English. The English version is a translation provided for convenience. In the event of any discrepancy between the two versions, the German version shall prevail.
